Your options if your immigration application or visa application has been refused

Immigration appeal to the First-Tier Tribunal (Immigration and Asylum Chamber)
 
You may be able to appeal to the First-Tier Tribunal (Immigration and Asylum Chamber) in the following circumstances:
·  Your application for asylum or request for humanitarian protection has been refused or your protection has been revoked
· You held British citizenship and this has been revoked
· You are entitled to be in the UK on a human rights basis but your application has been denied
· You have been refused residence or deported but you believe you have a right to live in the UK under the Immigration (European Economic Area) Regulations or the EU settlement scheme
· Your EU settlement scheme travel permit or family permit has been refused or revoked
· You are a frontier worker and you have been refused a permit or your permit has been revoked
·  You planned to visit the UK for health treatment as an S2 healthcare visitor but your visa has been refused or revoked

Immigration appeal to the Upper Tribunal (Immigration and Asylum Chamber)
 
If your appeal to the First-Tier Tribunal is not successful, you may be able to appeal to the Upper Tribunal if an error in law was made when your case was decided. We can advise you as to whether you have grounds for asking for an appeal to the Upper Tribunal.
You will need the consent of the First-Tier Tribunal to make a further appeal and we can request this, putting forward a strong argument on your behalf.
 
Administrative review of a visa or immigration rejection
 
If you believe that an error was made in the processing of your visa or other application, you may be able to ask for an administrative review. We will let you know if your case is suitable for review and, if it is, prepare the request. UK Visas and Immigration will then look again at your application and consider whether it should have been approved. No new evidence can be sent at this stage and the immigration authorities are only looking for errors in their original dealing with the case.
 
Judicial review of a visa or immigration rejection
 
If the decision in your immigration application was illegal, procedurally unfair or irrational, then you may be entitled to ask for a judicial review. If a judicial review is successful, then your application will be returned to UK Visas and Immigration to be reconsidered.
